Abstract

Undang-Undang Nomor 23 Tahun 2014 telah menjadi acuan dan dasar hukum dalam melakukan penetapan batas wilayah maritim. Adapun batas maritim pada tingkat daerah terdapat dua batas, yaitu batas wilayah pengelolaan laut yang menjadi wewenang pemerintah provinsi dan batas bagi hasil kelautan kabupaten/kota. Sesuai dengan peraturan yang berlaku, garis pangkal yang digunakan adalah normal baseline, yaitu garis pangkal yang mengikuti garis pantainya. Provinsi Bangka Belitung sendiri memiliki potensi yang besar di bidang maritim, oleh karena itu sangat penting untuk melakukan penetapan batas wilayah maritimnya. Untuk menentukan batas wilayah pengelolaan lautnya, perlu dilakukan buffer sejauh 12 mil laut terhadap garis pantai yang mengacu High Water Level (HWL). Apabila terdapat dua wilayah yang saling berhadapan dengan jarak kurang dari 24 mil laut, maka penarikan batasnya menggunakan metode median line sebagai solusi untuk menyelesaikan permasalahan batas wilayah maritim di Provinsi Bangka Belitung, metode median line adalah metode penentuan garis tengah di antara dua daerah yang saling berhadapan. Namun jika terdapat dua wilayah yang berdampingan, penarikan batasnya menggunakan prinsip equidistance ,metode equidistance adalah sebuah metode untuk menentukan batas menggunakan garis-garis yang sama jarak . diperoleh luas wilayah pengelolaan lautnya adalah 37.172,16 km². , sedangkan untuk menentukan batas bagi hasil kelautannya dilakukan buffer sejauh 4 mil laut dan diperoleh luas keseluruhannya adalah 15.629,04 km².

Law Number 23 year 2014 has become a reference and legal basis in determining maritime boundaries. As for the maritime boundaries at the regional level, there are two boundaries, namely the boundaries of the management area which is the authority of the provincial government and the boundaries for the district/municipal marine products. In accordance with the applicable regulations, the baseline used is the normal baseline, which is the baseline that follows the coastline. The province of Bangka Belitung itself has great potential in the maritime sector, therefore it is very important to define the boundaries of its maritime territory. To determine the boundaries of the marine management area, it is necessary to carry a buffer of 12 nautical miles to the coastline referring to High Water Level (HWL). If there are two areas facing each other with a distance of 24 nautical miles, then the drawdown of the boundary uses the center line method as a solution to solve the problem of maritime boundaries in Bangka Belitung Province. However, if there are two amazing areas, drawing the boundaries using the equidistance principle, the equidistance method is a method for determining boundaries using equidistant lines. obtained the area of marine management is 37,172.16 km². , while to determine the limit for the distribution of marine products, a buffer of 4 million seas is carried out and the total area is 15,629.04 km².
