Abstract

Pesatnya kemajuan teknologi informasi dan komunikasi menimbulkan berbagai peluang dan tantangan dimana manusia dapat saling terhubung satu sama lain tanpa mengenal batas wilayah. Hal ini menjadi alasan adanya pertukaran data yang dapat mengakibatkan data pribadi seseorang dapat dengan mudah dikumpulkan, disimpan, dikelola atau dipindahkan dari satu pihak ke pihak yang lainnya tanpa persetujuan pemilik data pribadi. Permasalahan ini mendesak pemerintah untuk menerapkan landasan hukum yang kuat dalam melindungi data pribadi. Dalam hal ini kepedulian menjadi sangat penting untuk memberikan wawasan dan pemahaman akan pentingnya perlindungan data pribadi tersebut dan faktor motivasi apa yang dapat menjadi dasar bagi pegawai pemerintah daerah dalam melakukan perlindungan data pribadi. Tujuan dari penelitian ini yaitu untuk mengeksplorasi kepedulian dan faktor apa yang memotivasi pegawai pemerintah daerah dalam melakukan perlindungan data pribadi. Penelitian ini menggunakan metode kualitatif dengan pendekatan studi kasus Pemerintah Kota Surabaya dengan objek penelitian yaitu walidata yang berwenang terhadap data tersebut. Dari hasil pengumpulan data dapat disimpulkan bahwa pegawai pemerintah daerah peduli akan perlindungan data pribadi yang diinisasi oleh adanya tiga elemen kepedulian yaitu pengetahuan, concern, dan personality untuk melakukan perlindungan data pribadi. Motivasi pegawai pemerintah daerah dalam melakukan implementasi perlindungan data pribadi adalah kondisi psikologi, punishment, kerugian, dan tuntutan. Dengan hasil penelitian yang diidentifikasi tersebut diharapkan dapat menjadi pertimbangan pemerintah Indonesia untuk bisa mengimplementasikan perlindungan data pribadi dengan baik.

The rapid advancement of information and communication technology raises opportunities and challenges for humans to connect without knowing regional boundaries. This is the reason for the exchange of data, which can result in a person's data is easily collected, stored, managed, or transferred from one party to another without the consent of the personal data owner. This problem urges the government to apply a solid legal basis in protecting personal data. In this case, the concern is significant to provide insight and understanding of the importance of protecting personal data and what motivational factors can be the basis for local government employees to protect personal data. The purpose of this study is to explore what concerns and factors motivate local government employees to protect personal data. This research uses a qualitative method with a case study approach to the Surabaya City Government with the object of research, namely the data guardian authorized to the data. From the data collection results, it can be concluded that local government employees care about the protection of personal data, which is initiated by the presence of three elements of concern, namely knowledge, concern, and personality, to protect personal data. The motivation of local government employees in implementing personal data protection is psychological conditions, losses, and demands. With the research results identified, it is hoped that the Indonesian government will consider implementing the protection of personal data properly
