Abstract

Pada sistem performance based contract risiko yang harus ditanggung oleh pihak penyedia jasa semakin besar. Pembagian risiko antara pemilik proyek dan penyedia jasa merupakan salah satu kendala dalam penerapan performance based contract (PBC), apabila penyedia jasa menanggung risiko pekerjaan yang seharusnya ditanggung oleh pemilik proyek akan menimbulkan kondisi yang tidak baik. Proyek dengan sistem Kontrak Berbasis Kinerja di Indonesia masih dalam taraf Pilot Project sehingga sebagian ketentuan-ketentuannya masih gabungan dengan sistem kontrak biasa, sehingga perlu untuk menentukan alokasi dan risk response yang timbul selama proses pembangunan jalan. Identifikasi dan penilaian risiko pada sistem performance based contract telah dilakukan pada penelitian sebelumnya yang digunakan sebagai pedoman penentuan variabel risiko dan level risiko sebelum dilakukan response. Penelitian ini bertujuan untuk menentukan alokasi risiko dan menentukan risk response serta skor probabilitas dan skor dampak setelah dilakukan response berdasarkan persepsi responden. Metode pengumpulan data dengan menggunakan kuisioner dan interview. Data yang didapat dilakukan analisa deskriptif untuk didapatkan alokasi risiko dan pada risk response menggunakan failure mode and effects analysis (FMEA) modifikasi. Hasil analisa alokasi risiko didapatkan bahwa risiko yang diterima oleh pemilik sebesar 2%, kontraktor sebanyak 67 % dan shared sebanyak 31%. Hasil analisa tingkat risiko yang didapat group risiko konstruksi menempati tingkat risiko tertinggi, sedangkan group risiko desain/perencanaan menempati posisi kedua, group risiko pemeliharaan menempati posisi ketiga dan group risiko pengadaan menempati posisi ke empat.

Performance based contract (PBC) system, many risk should be borne by service provider. Hence, sharing risk between owner and service provider become one of problems in the application of PBC. The problem occurred if service provider take the risk that supposed to be owner responsible and then effect to project failed. In Indonesia, PBC is still in pilot project. The regulation used in PBC have no difference with common contract, including about sharing risk. With this in mind, it is important to determine risk allocation and response during the construction in PBC. However, identification of risk in PBC system had been studied in previous research. The risk identified is used as standard for determining variable and level of risk before the implementation of risk response. Moreover, this study has purpose to determine risk allocation a perspective contractor, risk response, probability score and impact score after the implementation of risk response. Questionnaire and depth interview was used to collect the data. Furthermore, data collected was analyzed descriptif to get risk allocation and level of risk after implementation of risk response used failure mode and effect analysis (FMEA) modified. The results showed that the risk should be borne by owner is 2%, by contractor is 67%, and share by both parties is 31%. Most risk occurred in construction phase than other stage. It is followed by planning phase, maintenance phase, and procurement phase, respectively.
