Abstract

Praktik BIM akan menghadirkan tantangan teknis hingga kontraktual terkait ketidaksepakatan antara berbagai pihak mengenai pengalokasian beban pembiayaan, kepemilikan, dan penentuan model kontrak. Dari tiga konflik tersebut telah memunculkan tiga pertanyaan penelitian yang mendorong dilakukannya penelitian ini, diantaranya adalah, siapa yang harus membiayai? siapa yang memiliki model dari hasil kolaborasi? model kontrak apa yang paling tepat?. Tujuan dari penelitian ini adalah untuk mengetahui faktor-faktor prioritas pelaku pembiayaan, kepemilikan model dan hak atas kekayaan intelektual, dan model kontrak yang paling tepat untuk penerapan BIM di Indonesia. Penelitian ini menggunakan pendekatan kualitatif data primer, kuesioner dibagikan kepada pihak yang terlibat dan berpengalaman dengan proyek berbasis BIM di Indonesia. Penelitian ini mengadopsi statistik deskriptif dan inferensial untuk menganalisis data yang diperoleh dari responden.
Hasil penelitian menunjukan bahwa, pihak perusahaan konstruksi adalah faktor utama sebagai prioritas pelaku pembiayaan dan menjadi pusat pertanggung jawaban finansial untuk implementasi BIM di Indonesia. Terkait kepemilikan model dari hasil kolaborasi, pihak yang membuat elemen model adalah faktor utama yang memiliki model dan hak atas kekayaan intelektuanya. Sedangkan owner sebagai pihak pemberi kerja akan memiliki hak kepemilikan model dari BIM dalam bentuk lisensi, dengan keterbatasan penggunaan hanya untuk operasional, pemeliharaan, dan pemasaran, tidak memiliki hak untuk menggunakan kembali model tersebut untuk pembangunan proyek berikutnya. Model kontrak yang dapat melibatkan kontraktor pada tahap desain adalah faktor utama dari model kontrak yang paling tepat untuk penerapan BIM di Indonesia. Keterlibatan kontraktor pada tahap desain dapat memberikan peluang bagus untuk mengeksploitasi teknologi BIM dalam proses kerja yang lebih kolaboratif. Penelitian ini, diharapkan dapat berkonstribusi pada body of knowledge dan memberikan rekomendasi untuk pengambilan kebijakan dalam kontrak konstruksi untuk mengelola proyek berbasis BIM di Indonesia dengan lebih baik.

The practice of BIM will present technical to contractual challenges related to disagreements between various parties regarding the allocation of financing expenses, ownership, and determination of contract models. Of the three conflicts that have raised three research questions that encourage the conduct of this research, among them, who should finance? who has the model of collaboration? what contract model is most appropriate?. The purpose of this study is to determine the priority factors of financing actors, ownership of models and intellectual property rights, and the most appropriate contract model for the implementation of BIM in Indonesia. This research uses qualitative approach of primary data, questionnaires are distributed to parties involved and experienced with BIM-based projects in Indonesia. The study adopted descriptive and inferential statistics to analyze data obtained from respondents.
The results showed that construction companies are the main factor as the priority of financing actors and become the center of financial responsibility for the implementation of BIM in Indonesia. Regarding the ownership of the model from the results of collaboration, the party that makes the model element is the main factor that owns the model and the right to intellectual property. While the owner as the employer will have the right to own the model of BIM in the form of a license, with limited use only for operations, maintenance, and marketing, do not have the right to reuse the model for the construction of the next project. The contract model that can involve contractors at the design stage is the main factor of the most appropriate contract model for the implementation of BIM in Indonesia. Contractor involvement at the design stage can provide a great opportunity to exploit BIM technology in a more collaborative work process. This research is expected to contribute to the body of knowledge and provide recommendations for policy making in construction contracts to better manage BIM-based projects in Indonesia.
