Abstract

Pembangunan infratruktur dinilai sangat penting dalam upaya pemenuhan kebutuhan publik bagi pemerintah. Namun, kebutuhan dana yang sangat besar membuat pemerintah harus mencari alternatif lain. Skema pembiayaan dengan Kerjasama Pemerintah dan Badan Usaha (KPBU) diupayakan mampu menjawab permasalahan sebagai pengadaan yang efektif. KPBU adalah investasi jangka panjang dan melibatkan banyak stakeholder, sehingga menjadi sangat rentan terhadap konflik. Penelitian ini akan mengambil konteks KPBU pada sektor perkeretaapian, mengingat stakeholder pada sektor ini cukup banyak dan kompleks sedangkan penelitian untuk sektor ini masih relatif terbatas. Penelitian ini memiliki tujuan menganalisis secara mendalam mengenai permasalahan mengenai penyebab konflik dan penyelesaiannya pada proyek KPBU sektor kereta api di Indonesia, yaitu Proyek Kereta Api Makassar-Parepare. Pemilihan proyek ini karena memiliki investasi jangka panjang selama 17 tahun masa kerjasama, dan proyek merupakan proyek infrastruktur dengan kompleksitas tinggi. Hal tersebut berpotensi menimbulkan perselisihan, seperti pada saat penyiapan trase jalan kereta api sehingga mengalami keterlambatan jadwal, adanya kendala pada saat serah terima yang berkaitan dengan dokumen, dan belum adanya penelitian di KPBU sektor kereta api yang membahas mengenai manajemen konflik. Data pada penelitian ini menunjuk stakeholder yang berpengaruh terhadap pengambilan keputusan konflik di lapangan. Data ini telah dianalisis menggunakan Metode Thematic Analysis, yang mengeksplorasi permasalahan empiris sampai terbentuk sebuah fenomena, yaitu fenomena konflik. Hasil penelitian ini, menunjukkan bahwa fenomena konflik dari KPBU sektor kereta api disebabkan karena ambiguitas, kekurangan, dan inkonsistensi merupakan tema yang menyebabkan konflik dominan dan cluster tema selanjutnya adalah ketidakpastian proyek, yaitu dari ketidakpastian eksternal sebagai penyebab konflik dominan. Penyelesaian konflik diselesaikan dengan dua gaya negosiasi, antara lain diakomodasi oleh pihak penjaminan atau dengan kompromi kedua belah pihak. Diharapkan hasil ini dapat membantu keberhasilan proyek KPBU Perkeretaapian di Indonesia kedepannya.

Infrastructure development is considered very important in an effort to fulfill public needs for the government. However, the enormous need for funds makes the government have to look for other alternatives. The financing scheme with Public-Private Partnership (PPP) is sought to be able to answer the problem as an effective procurement. PPP is a long-term investment and involves many stakeholders, making it very vulnerable to conflict. This research will take place in the context of PPP in the railway sector, considering that the stakeholders in this sector are quite numerous and complex, while research for this sector is still relatively limited. This research aims to analyze in depth the problems regarding the causes of conflict and its resolution in the railway sector PPP project in Indonesia, namely the Makassar-Parepare Railway Project. This project was selected because it has a long-term investment for 17 years of cooperation, and the project is an infrastructure project with high complexity. This has the potential to cause disputes, such as during the preparation of the railroad trajectory so that it experiences schedule delays, there are obstacles at the time of handover related to documents, and there has been no research in the PPP railroad sector that discusses conflict management. The data in this study point to stakeholders who influence conflict decision making in the field. This data has been analyzed using the Thematic Analysis Method, which explores empirical problems until a phenomenon is formed, namely the conflict phenomenon. The results of this study, show that the conflict phenomenon of PPP in the rail sector is caused by ambiguity, insufficiency, and inconsistency is the theme that causes the dominant conflict and the next theme cluster is project uncertainty, which is from external uncertainty as the cause of the dominant conflict. Conflict resolution is resolved by two negotiation styles, including being accommodated by the guarantee party or by compromising both parties. It is hoped that these results can help the success of Railway PPP projects in Indonesia in the future.
