Abstract
Proyek Kereta Cepat Jakarta–Bandung menggunakan skema kontrak Engineering, Procurement, and Construction (EPC) Turnkey berdasarkan FIDIC Silver Book 2017 yang memiliki karakteristik kompleks, melibatkan banyak pemangku kepentingan, serta mengalokasikan sebagian besar risiko kepada kontraktor. Karakteristik tersebut meningkatkan potensi terjadinya sengketa teknis selama pelaksanaan proyek. Penelitian ini bertujuan mengidentifikasi faktor dominan penyebab sengketa teknis, menentukan ownership risk berdasarkan ketentuan FIDIC Silver Book 2017, serta merumuskan mekanisme penyelesaian melalui mekanisme administrasi kontrak. Penelitian menggunakan pendekatan kualitatif deskriptif dengan metode Delphi eksploratif yang divalidasi melalui Focus Group Discussion (FGD). Analisis dilakukan terhadap tiga studi kasus, yaitu Drainage DK100+920, Track Geometry K100–106, dan Access of Auxiliary Building, dengan melibatkan 11 pakar yang mewakili pihak Employer, Contractor, dan Consultant. Hasil penelitian menunjukkan bahwa sengketa teknis didominasi oleh lima faktor utama, yaitu Design & Functionality System, Track Stability & Ballasted Track Performance, Subgrade Condition Variability, Maintenance Dependency & Rectification Approach, serta External Dependency & Interface Risk. Pemetaan terhadap ketentuan FIDIC Silver Book 2017 menunjukkan bahwa faktor-faktor tersebut termasuk dalam kategori Contractor Risk, Employer Risk, dan Shared Risk. Berdasarkan hasil analisis tersebut, mekanisme administrasi kontrak yang direkomendasikan meliputi Joint Coordination, Joint Technical Investigation, Technical Rectification, Defect Rectification, Completion of Outstanding Work, Variation Order (VO), dan Extension of Time (EOT) sesuai dengan ketentuan kontrak. Penelitian ini menghasilkan penyelesaian sengketa teknis yang mengintegrasikan faktor penyebab sengketa, ownership risk, dan mekanisme administrasi kontrak berdasarkan FIDIC Silver Book 2017.

The Jakarta–Bandung High-Speed Railway Project adopts an Engineering, Procurement, and Construction (EPC) Turnkey contract scheme based on the FIDIC Silver Book 2017, which is characterized by high complexity, the involvement of multiple stakeholders, and the allocation of most project risks to the Contractor. These characteristics increase the potential for technical disputes during project execution. This study aims to identify the dominant factors causing technical disputes, determine ownership risk based on the provisions of the FIDIC Silver Book 2017, and formulate appropriate resolution mechanisms through contract administration mechanisms. A descriptive qualitative approach was employed using an exploratory Delphi method, which was subsequently validated through a Focus Group Discussion (FGD). The analysis was conducted on three representative case studies: Drainage DK100+920, Track Geometry K100–106, and Access to the Auxiliary Building, involving eleven experts representing the Employer, Contractor, and Consultant. The results indicate that technical disputes are predominantly caused by five major factors: Design & Functionality System, Track Stability & Ballasted Track Performance, Subgrade Condition Variability, Maintenance Dependency & Rectification Approach, and External Dependency & Interface Risk. Mapping these factors to the provisions of the FIDIC Silver Book 2017 classifies the associated risks into Contractor Risk, Employer Risk, and Shared Risk. Based on these findings, the recommended contract administration mechanisms include Joint Coordination, Joint Technical Investigation, Technical Rectification, Defect Rectification, Completion of Outstanding Work, Variation Order (VO), and Extension of Time (EOT) in accordance with the contractual provisions. This study proposes a technical dispute resolution that integrates the dominant dispute factors, ownership risk, and contract administration mechanisms based on the FIDIC Silver Book 2017.
