Abstract
Kontrak Turnkey ini seharusnya diselesaikan tahun 2016 – 2019 untuk target fungsional lebaran, tetapi karena banyak lahan yang belum bebas menyebabkan progres hanya tercapai 51% ( STA 00+000 - 41+000) dan kondisi pendanaan dari pemilik proyek, serta untuk tetap memenuhi target fungsional tersebut maka pemilik proyek membuat kebijakan untuk menyelesaikan sampai dengan STA 41+000 dan membuat exit tol temporary menuju Palembang dengan biaya ± Rp. 50 miliar. Konstruksi Tahap 2 dimulai pada akhir tahun 2021 - 2023, dengan satu kesatuan kontrak dengan pekerjaan tahap 1. Adanya penambahan anggaran untuk exit tol temporary menuju Palembang, biaya pembebasan lahan dan jeda waktu pelaksanaan yang bertambahan menyebabkan harga sudah tidak relevan lagi dengan tahun berjalan, sehingga pemilik proyek berinisiasi melakukan optimalisasi dengan review design untuk mengejar target penyelesaian 2023. Optimalisasi ini tentunya akan menimbulkan perselisihan / sengketa jika tidak ada kesepakatan antara pemberi jasa dan penyedia jasa. Tesis ini bertujuan untuk menganalisa pengumpulan data Kriteria & Sub Kriteria menggunakan pendekatan metode Modified Delphi dan untuk mendapatkan alternatif terbaik menggunakan pendekatan metode Promethee ditinjau dari penyelesaian perselisihan / sengketa. Penentuan Kiteria dan Sub Kriteria yang sudah diperoleh melalui studi literatur & wawancara mendalam selanjutnya dilakukan analisis pengumpulan data menggunakan Metode Modified Delphi dengan 5 putaran untuk mendapatkan Kriteria. Dengan kriteria Schedule 35 %, Cost 32,22 % dan Quality 32,78 %. Alternatif yang paling dominan atau terbaik merujuk hasil Analisis Metode Promethee adalah Alternatif – 3 Analisis pemilihan ketentuan umum kontrak dengan The NEC4 Engineering and Construction Contract (ECC).

This Turnkey Contract should have been completed in 2016 – 2019 for the functional target of Eid, but because many lands have not been acquired, the progress has only reached 51% (STA 00+000 - 41+000) and the funding conditions of the project owner, and to continue to meet the functional target, the project owner made a policy to complete up to STA 41+000 and build a temporary toll exit to Palembang at a cost of approximately fifty billion. Phase 2 construction began at the end of 2021 - 2023, with a single contract with phase 1 work. The additional budget for the temporary toll exit to Palembang, land acquisition costs and the increased implementation time lag caused the price to be no longer relevant to the current year, so the project owner initiated optimization with a design review to achieve the 2023 completion target. This optimization will certainly lead to disputes / disputes if there is no agreement between the service provider and the service provider. This thesis aims to analyze the data collection of criteria and sub-criteria using the Modified Delphi method and to identify the best alternative using the Promethee method in terms of dispute resolution. The criteria and sub-criteria were determined through literature review and in-depth interviews. Data collection was then analyzed using the Modified Delphi method with five rounds to identify the criteria. The criteria were Schedule 35%, Cost 32.22%, and Quality 32.78%. The most dominant or best alternative, based on the Promethee method analysis results, was Alternative 3, an analysis of the selection of general contract provisions with the NEC4 Engineering and Construction Contract (ECC).
