Abstract

Saat ini sertifikat garis muat tongkang geladak berbendera Indonesia pada umumnya menerapkan ketentuan Konvensi Internasional Garis Muat 1966 (ICLL’66). Selain ketentuan garis muat Konvensi, di Indonesia juga terdapat ketentuan garis muat Non Konvensi yaitu berupa Peraturan Menteri Perhubungan Nomor 39 Tahun 2016 (PM.39/2016); dan untuk tongkang geladak, ketentuan tersebut lebih lanjut diatur dalam Peraturan Direktur Jenderal Perhubungan Laut Nomor HK.103/2/16/DJPL-17. Pemilik/operator tongkang bisa memilih apakah tetap menerapkan sertifikasi garis muat sesuai Konvensi (ICLL’66) ataukah menggantinya sesuai ketentuan Non Konvensi (PM.39/2016). Penelitian ini bertujuan untuk membandingkan perbedaan penerapan ketentuan garis muat antara Non Konvensi (PM.39/2016) dengan Konvensi (ICLL’66) dari sisi komersialnya serta menganalisis dampak komersial penerapan regulasi garis muat Non Konvensi menggantikan garis muat Konvensi pada tongkang geladak dengan menggunakan metode Analisis Diferensial dengan studi kasus pada tongkang TK. MG-3002 dan TK. MG-3306. Perubahan pendapatan (differential revenue) sehubungan penerapan regulasi Non Konvensi (PM.39/2016) menggantikan regulasi Konvensi (ICLL’66) dihitung berdasarkan pendapatan yang diperoleh dari kapasitas angkut pada sarat kapal maksimal penerapan kedua regulasi tersebut. Selanjutnya diidentifikasi biaya-biaya operasional kapal melalui kuisioner dan wawancara termasuk komponen dan besarnya biaya yang mengalami perubahan (relevant cost) jika terjadi perubahan penerapan sertifikat garis muat sehingga dapat dihitung perubahan biaya (differential cost) sehubungan penerapan regulasi Non Konvensi (PM.39/2016) menggantikan regulasi Konvensi (ICLL’66). Dampak komersial penerapan regulasi Non Konvensi (PM.39/2016) menggantikan Konvensi (ICLL’66) dapat diketahui dengan menghitung selisih dari differential revenue dengan differential cost yang merupakan keuntungan/kerugian yang diperoleh pemilik/operator tongkang jika dilakukan perubahan penerapan sertifikasi garis muat. Dari analisis menunjukkan bahwa secara komersial penerapan regulasi Non Konvensi (PM.39/2016) menggantikan Konvensi (ICLL’66) pada kasus kedua tongkang menguntungkan pemilik/operator. Selain itu, keuntungan penerapan regulasi Non Konvensi menggantikan Konvensi akan diperoleh pemilk/operator jika Panjang tongkang 300 ft atau lebih, sedangkan untuk tongkang dengan Panjang kurang dari 300 ft, perubahan penerapan regulasi garis muat tersebut tidak menguntungkan.

Currently the Indonesian flagged deck cargo barge load line certificate generally applies the provisions of the International Convention on Load Line 1966 (ICLL'66). Besides the provisions of the Convention's load line, in Indonesia there is also a Non-Convention load line provision in the form of Minister of Transportation Decree Number 39 year 2016 (PM.39/2016); and for deck cargo barge, these provisions are further regulated in the Director General of Sea Transportation Decree Number HK.103/2/16/DJPL-17. Barge owners/operators may choose whether to continue implementing load line certification according to the Convention (ICLL '66) or to replace it according to the provisions of the NonConvention (PM.39/2016). This study aims to compare the differences between the application of NonConvention load line provisions (PM.39/2016) and the Convention (ICLL'66) from the commercial view and to analyze the commercial impact of the implementation of Non-Convention loadline regulations replacing the Convention load line on deck cargo barges using Differential Analysis method with case studies on barges TK. MG-3002 and TK. MG-3306. Differential revenue in connection with the application of Non-Convention regulations (PM.39/2016) replacing Convention regulation (ICLL'66) was calculated based on income obtained from cargo capacity on a maximum draught of the application of both regulations. Furthermore, identified ship operating cost through questionnaires and interviews including the components and the amount of cost that have changed (relevant cost) if there is a change in the implementation of the load line certificate so that the differential cost could be calculated in relation to the application of Non-Convention regulations (PM.39/2016) replacing the Convention regulation (ICLL'66). The commercial impact of the application of Non-Convention regulations (PM.39/2016) replacing the Convention (ICLL66) can be known by calculating the difference from differential revenue with the differential cost which is the gain/loss obtained by the barge owner/operator if changes to the implementation of the load line certification are carried out. The analysis shows that commercially the application of Non-Convention regulations (PM.39/2016) replacing the Convention (ICLL’66) in the case of both barges benefiting the owner/operator. In addition, from the analysis it shows that changes in the application of Non-Convention regulations in place of the Convention would benefit the owner/operator if the barge length was 300 ft or more, while for barges with less than 300 ft in length, changes in the application of the load line regulations were not profitable.
